They don't have them. Instead the collection companies submit the declarations of their own lawyers as "evidence" supposedly verifying that years before MBNA sent a consumer a photocopied bill stuffer that says in small print that any dispute is to be heard in arbitration. So no, its not fair and no one has agreed to arbitration in most cases.
